Sambram Terms of use

These policies are published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, and are an ‘electronic record’ as contemplated under section 2(t) of the Information Technology Act, 2000 and the Rules thereunder. These Terms being an electronic record are generated by a computer system and do not require any physical or digital signatures.

How It Works:

1. Refer a Friend: Simply refer someone you know to our platform using your unique referral code or link.

2.Exclusive Rewards: For every successful referral i.e. if your reference makes a purchase on sambram.com your friend will receive a Referral Discount on his purchase, and, you will receive a Referral Bonus. We believe in rewarding loyalty, so the more referrals you make, the better the rewards become.

3. Upgrade Your Status: As you reach different referral milestones, your status in our program will elevate. With each level, you unlock even more exciting benefits, such as priority access, personalized offers, and dedicated support.

SAMBRAM Referral Program - Terms and Conditions

1.Program Overview:

SAMBRAM Referral Program allows registered users of SAMBRAM to earn rewards by referring friends or contacts ("Referrals") to buy our products via www.sambram.com

2.Eligibility:

The Program is available to all registered SAMBRAM users who have reached the legal age.

3.How to Participate:

a. Participants can participate in the Program by sharing a referral link in SAMBRAM through their account dashboard or designated sharing tools.

b. When a Referral (buyer) clicks on the unique referral link, they will be directed to our website or app to sign up or make a purchase.

c. To qualify for the reward, the Referral (Buyer) must complete the specified action, such as signing up, making a purchase, or meeting any additional criteria specified by SAMBRAM.

4. Reward:

a. Participants will be eligible to earn a reward Referral Bonus for each successful Referral who completes the specified action.

b. The nature and value of the Reward will be determined by SAMBRAM, and it may be subject to change at any time without prior notice.

c. The Reward is non-transferable and cannot be exchanged for cash or any other alternatives.

d. The Referral (buyer) who use the link and execute a purchase will be eligible to use the referral code and obtain referral discount.

5. Reward Distribution:

a. Rewards will be credited to the Participant's account within a reasonable time after the successful Referral completes the specified action.

b. Participants may be eligible for the Reward only if the Referral's action is verified and deemed genuine by SAMBRAM.

c. In case of any disputes regarding the Reward, SAMBRAM's decision will be final and binding.

6. Prohibited Activities:

a. Participants may not engage in any fraudulent, deceptive, or unethical practices to gain Referrals.

b. Participants may not use spam or unsolicited communication to promote the Program.

c. Participants may not create multiple accounts or engage in any activities that could manipulate or exploit the Program.

7. Termination and Modification:

a. SAMBRAM reserves the right to terminate or modify the Program at any time and for any reason without prior notice.

b. Participants will be notified of any significant changes to the Program through email or other communication channels.

8. Privacy:

a. By participating in the Program, Participants consent to the collection and use of their personal information in accordance with SAMBRAM’s privacy policy.

9. Liability:

a. SAMBRAM is not responsible for any technical issues, errors, or delays that may occur during the Program.

10 +1 Investment scheme

The 10 +1 saving scheme builds your gold assets at regular intervals for healthy financial stability.

Salient Features & Benefits

1. You can start an account with a minimum saving of Rs. 1000/-, in multiples of Rs. 1000/-, as regular monthly installments.

2.The duration of this scheme is 11 months.

3.The monthly installments are payable at the website after login in and selecting the respective payment method.

4.11th month installment will be borne by the company.

5.You will save your money as money and by the end of the maturity period you can buy gold coins /ornaments or silver articles equivalent to the prevailing market rate.

6.You can purchase gold coins & silver coins corresponding to the credit in your account.

7.Pay installments using credit/debit cards or even through online fund transfer at your convenience (service charges applicable) within the due date.

8.You can also pay installments through a Bank transfer account number (virtual account number) by transferring funds either in the bank or through internet banking facility (NEFT/RTGS/IMPS).

Terms & Conditions

1.Pay your monthly installments on or before the due date to avail the benefit of 11th month installment borne by the company.

2.The amount you choose for the first installment will be set as the amount to be paid for every other installments.

3.This scheme shall cover only coins and jewels available for sale on the website and not for customized jewels.

4.Premature closing of the scheme shall not be entertained.

5.• Successfully paying all the installments on or before due date for the entire scheme period will only make participant to avail the benefit of 11th month installment borne by the company.

6.This scheme is a unique scheme and cannot be merged, converted, or transferred with either new or existing schemes.

7.SAMBRAM reserves every right over the terms and conditions of this scheme and reserves the right to change the conditions at any time.

8.In case of any change in existing laws, rules, acts, etc., by a Regulatory authority, the necessary requirements have to be complied with, by the customer. SAMBRAM reserves the right to enforce such a compliance.

9.The deposited amount will not be refunded as cash, in any case

Access to the App

The Sambram App is owned by MRK INNOAPPS PRIVATE LIMITED, a company incorporated under the Companies Act, 1956. Sambram Services merely provides a Technology Platform to its registered users. Use of the App by the user (“You”/ “User”) is subject to the terms and conditions contained herein. Accessing, browsing or otherwise using the App will be construed as Your unequivocal and irrevocable acceptance and acknowledgement to the terms and conditions contained under Terms of Use and binding policies hereof. By using the App, You declare to have carefully read, understood and agree to be bound by these Terms of Use. Sambram may at its sole discretion allow or disallow access to App and reserves the right to change any of the terms and conditions contained herein at any point in time. It is Your responsibility to periodically review these Terms of Use any update and changes and Your continued use of the App will be considered as Your acceptance to such updates and changes.

Eligibility

You should have completed 18 years of age and be competent to enter into a contract under Indian contract law. If You are under 18 years of age who is intending to avail the services of the App should do so through Your legal guardian in accordance with applicable law.

If You are using the App on behalf of any corporation, company, institution, association or other entity, the person should be authorized by such corporation, company, institution, association or other entity to use and access the App.

Sambram reserves the right to refuse access to use the services offered at the App to new users or to terminate access granted to existing users at any time without according any reasons for doing so.

Compliance Requirements

Every User of the App shall comply with all the applicable laws, including but not limited to the Foreign Exchange Management Act, 1999, notifications issued there under the Exchange Control Manual issued by the Reserve Bank of India, Customs Act, 1962, Information Technology Act, 2000, Prevention of Money Laundering Act, 2002, Foreign Contribution Regulation Act, 1976, Income Tax Act, 1961, Export Import Policy of the Government of India and shall include any amendments, notifications and Rules thereof under the aforesaid enactments applicable for using the App or buying/ selling any product or service through the App.

User Account

You may be required to register and set up an account (“Account”) for using the App by entering an email address and password or by using any permitted social media the App account to sign in ("Account Information"). Sambram as its sole discretion may ask for the verification of Your Account Information provided by You and hence, it is advisable to provide a valid information e.g. like email address or mobile number etc. while creating an Account. The App will set-up an account and email the details of the Account at the email address provided. You can also create and update an Account through Customer Support.

You can create one Account only and it is not permitted to transfer or interchange such Account to any other person. The list of information required to be provided by You, the manner of usage, protection and confidentiality of Your information and Account information are more specifically dealt under the App’s Privacy Policy and You are requested to read the Privacy Policy in detail before sharing Your information or creating an Account.

Payment Policy

Payment is an integral part of an online shopping experience. All payments shall be collected through secured payment options.

We accept all prepaid payment options such as all the major Credit Cards, Debit Cards, Net-Banking etc.

All payments for purchases made by You on the App shall only be in Indian Rupees. After payment for the order has been successfully received by Sambram, You will be sent a notification by email or SMS at the email address or mobile number provided to Sambram confirming receipt of payment.

Credit and Debit Card

Sambram accepts all Visa, Master Card, Maestro, American Express and Diners cards. You will be redirected to Your issuing bank's site, where You will have to follow the instruction to complete the payment.

You can make payment for an order by using Your Net Banking account. The App accepts payments for Your orders to sellers through various banks. You will be redirected to Your bank's site where You will be able to make payment after entering in Your login id and password that is known only to You.

Issues with Payments - Pending Payments:

Payments can sometimes fail or remain in the pending stage. Some of the reasons could be:

1. Incorrect debit or credit card details are entered.

2. Card may be blocked or card details are no longer valid or need to be updated.

3. The page is accidentally closed or refreshed or backspace is pressed while the transaction is being processed by Your bank.

4. The connection between Sambram and Your bank or issuer failed due to some technical reasons and the transaction could not be completed.

5. Card or bank or issuer is not recognised by Sambram.

6. Incorrect login or password details are entered.

7. Payment amount exceeds the limit mutually agreed to between You and Your bank or issuer.

If You face any of the above payment issues, try placing the order again in a short while or contact Your bank or issuer for technical assistance. Sambram is not liable for any loss or inconvenience caused to You when making payment or for any wrongful debits to Your cards or net banking accounts. Issuing Bank Terms and Conditions

Users understand and acknowledge that all payments made by the Users using valid credit card/ Debit card/ Cash Card/ and other payment instruments or mechanism including net banking facility will be processed using a payment gateway or appropriate payment system infrastructure and the same is governed by a separate set of terms and conditions agreed between the User and the respective Issuing Bank and payment instrument issuing company.

Requirements of Permanent Account Number (PAN)

For all the purchase of an amount equal to or exceeding INR 2,00,000 (INR two lakhs only), You will be required to upload a copy of Your PAN card, within such time as may be prescribed from the date of purchase, failing which, the purchase made by You will be automatically cancelled. The order shall also stand cancelled if there is a discrepancy between Your name in Account with Sambram the name printed on the PAN card.

The requirement to provide a copy of PAN card is one time activity and You don’t need to submit it again.

Delivery Policy

Shipping Address

Your shipping address and pin code will be verified with the database of Sambram before You proceed to pay for Your purchase. In the event Your order is not serviceable by our logistics service providers or the area is not covered, we will request You to provide us with an alternate shipping address. You can make purchases on the App from anywhere in the world but at the same time You must ensure the payment and shipping address is within India.

When You submit an alternative address for delivery, You are responsible for accepting and collecting the package from such alternative address. Confirmation from the logistics service provider of successful delivery to the alternative shipping address is deemed as acceptance of delivery by You and Sambram will have no liability in this regard.

Delivery by Sambram seller

The delivery of the ordered products from the seller to You will be made by logistics service providers assigned by Sambram sellers. The logistics service provider assigned by Sambram will make a maximum of two [2] attempts to deliver Your order. In case You are not reachable, available or do not accept delivery of products in these attempts Sambram reserves the right to cancel the order at its discretion. You may be informed of such cancellation by email or SMS at the email address or mobile number provided to Sambram. The cancelled order is returned to seller. You agree not to hold Sambram liable for any cancellation.

If You wish to request the App to resend the product, You can do so by placing a new order for the product on the terms set out on the [‘product order page’] when You place the new order. Your order will be accepted subject to availability of the product.

In case there is any dispute regarding the shipment of the product or serviceability for the area not covered by the logistics service providers, Sambram will not be responsible for the non-delivery of the product.

Title and risk of loss for all products ordered by You shall pass on to You upon delivery of the products at the shipping address provided by You.

Multiple Product Orders

In case You order multiple products in one transaction, Sambram would endeavour to ship all products together. However, this may not always be possible due to some product characteristics or logistics issues or the location of seller and You may receive the products separately and at different times. If You purchase multiple products in a single transaction, then all the products would be dispatched to a single shipping address given by You. If You wish to ship products to different addresses, then You should book the orders separately based on the shipping addresses.

Disputes

All complaints relating to the products purchased from the App are routed through the Customer Care Team of the App. The seller is responsible to resolve any complaints regarding the product that may be raised by the buyer and other complaints to the satisfaction of the buyer. The App is only the facilitating link between the buyer and the seller of the product for any complaints in relation to the products sold by the seller. All buyer complaints, product complaints and transaction failure complaints shall solely be to the seller’s account and the seller shall undertake all necessary steps as may be required as per the complaint or redressal mechanism of the App to resolve the complaints at the seller’s own initiative and cost. The App is not in any way responsible for ensuring resolution of the complaints and the App shall not in any manner either directly or indirectly be liable for any claims or proceedings made by any User in relation to the products provided on or through the App or otherwise.

Limitation on Liablity

In no event Sambram including affiliates, associates and their respective owners, directors, officers, agents, shareholders and partners shall be liable for any loss or damage whatsoever including without limitation direct, indirect, punitive, incidental and consequential damages, lost profits, or damages resulting from the use or inability to use the App whether based on warranty, contract, tort (including negligence) or in any other means or action.

You acknowledge that Sambram is only an Intermediary as per definition under the Information Technology Act, 2000 and rules framed thereunder, between You and the seller and Sambram will not be held liable for any act of seller or other third party service provider.

Without prejudice, it is agreed by You that Sambram including affiliates, associates and their respective owners, directors, officers, agents, shareholders and partners shall not be held cumulatively liable for any damages or claims more than INR 1,000/- (Rupees One Thousand) subject to applicable law in respect of all matters and You acknowledge that this is reasonable assessment of risk and liabilities.

Indemnity

You agree to indemnify and hold harmless Sambram including affiliates, associates and their respective owners, directors, officers, agents, shareholders and partners from and against all actions, proceedings, claims, losses, damages and costs (including attorney fees) and other expenses suffered or incurred due to or attributable to or arising out of (i) violation of any applicable law (ii) breach of any representations, warranties or covenants of the User (iii) breach of the policies, guidelines and conditions of Sambram's service or Additional Terms or theseTerms or Privacy Policy (including any modifications or additional notifications or instructions); (iv) infringement of any third party rights. This Clause survives the termination of these Terms.

Termination

Sambram reserves the right to terminate the services provided to any User without prior notice in the event of any default committed by User including but not limited to the breach of any applicable law, policies, guidelines and conditions of Sambram’s service or Additional Terms or these Terms or the Privacy Policy (including any modifications or additional notifications or instructions). On such termination, the User’s information and other details shall be black listed by the App and shall be taken into consideration whenever necessary.

Sambram will terminate the services provided to any User if it is required under any applicable law. Without prejudice, Sambram reserves its right to terminate the services if such provision of services to the users is not economically viable for Sambram. Users may choose to discontinue availing services and facilities provided through the App by closing the User account with the App.

On termination of the User account, the User is not eligible to purchase or sell products through the App. Once the User’s account is terminated for any reason whatsoever, the contents, reviews, comments or other material posted on the App by the User shall be removed by Sambram.

Post termination of the services provided to the User through the App, the User’s personal information would reside in the App’s database for a certain period of time. It is also clarified that certain terms and conditions of the policies, guidelines and conditions of Sambram's service or Additional Terms or these Terms and the Privacy Policy continue to be binding on the User and if any User by default or otherwise is found using or dealing with the App post termination of the service provided through the App, the User shall be prosecuted by Sambram. The User shall be also liable to compensate Sambram for any unauthorized use of the App.

The terms and conditions of this agreement shall be governed by Indian law and the courts in Bangalore shall only have exclusive jurisdiction to resolve any disputes.
